PENN PARKING GENERAL TERMS OF CONTRACT MONTHLY PARKING APPLICATION One must read and agree to all of the terms and conditions set forth below to apply for monthly parking at any Penn Parking, Inc. parking facilities. Once these Terms and conditions are agreed to and submitted to Penn Parking, Inc., a representative of Penn Parking will be in contact with you the next business day to complete your application and contract. Monthly parking privileges run on a calendar month. All fees charged are for parking privileges only. Penn Parking, Inc. and/or property manger and/or owner reserves the right to increase or decrease the monthly license fee by giving notice, in writing and/or email correspondence, thirty days in advance of such change. All monthly fees are facility specific. Monthly payments are due to Penn Parking, Inc. on or before the fifth business day of the current month for use in that current month. Any payments received after the fifth business day of the current month for parking privileges for that month will be considered late and be subject to a $25.00 late fee charge. Any check payment made that does not clear and result in a non payment will result in a $25.00 handling fee payable immediately. Late, penalty, “bad” check, reactivation or monthly fees not paid may result in the termination of monthly parking privileges. Where applicable, a non-refundable fee for each access card and /or transponder and/or any device used to gain entry or exit to a parking facility obtained by the customer will apply. Any such device obtained by customer throughout this agreement hereinafter for whatever reason unless it is determined by Penn Parking. Inc. that said device is returned because it is inoperable through no fault of the customer shall carry the non-refundable fee. The non-refundable fee is facility specific. Where applicable, if a customer’s access device is deactivated because of non receipt of payment within the applicable time frame, reactivation of any such device will not take place until all overdue balances are paid in full including any and all past due balances, late or penalty fees and reactivation fees if applicable. Customer understands that any daily ticket pulled during a deactivation period is subject to the prescribed daily parking fees and are non refundable if and when monthly access is restored. Customer is guaranteed parking in the respective parking facility or assigned reserved parking space as long as this contract is in effect and payments are not in arrears. No refunds, credits or allowances will be granted for absence, vacation, or other non-use of the parking facility under this Agreement. Where applicable, a monthly hang tag or decal for monthly parking identification purposes will be issued and must be displayed at all times while said vehicle is parked in the respective parking facility. Any vehicle parked in any facility without the proper identification will be subject to pay the prescribed daily fee and/or be subject to towing by Penn Parking, Inc. at owner’s expense. If the customer is parking a vehicle that is not currently registered with Penn Parking, Inc., it is the responsibility of the owner of said vehicle to transfer any identification devices and register the change with Penn Parking, Inc. The prescribed daily fees will be charged for vehicle not possessing the proper identification devices and are non-refundable. No customer may reproduce or transfer any monthly identification device under any circumstance. Failure to abide by this rule will result in immediate termination of parking privileges and may result in criminal prosecution. If Penn Parking, Inc. has possession of any vehicle keys when a facility closes, said vehicle and keys will be secured and not available until the next business day. All identification device maintenance changes and/or updates to and within any existing group or individual account that is not terminating the account in full, at any period during the life of this contract and AS THEY OCCUR, must be reported to Penn Parking, Inc. Customer agrees and understands that any and all unreported changes that are discovered at a later date are the financial responsibility of the customer and all respective debits / credits resulting from any and all unreported changes are at Penn Parking, Inc.’s sole discretion. The customer fee payable under this agreement is for the privilege of using parking spaces only. Penn Parking, Inc. and/or owner, and/or property manager its employees and/or agents, assume no responsibility whatsoever for loss and/or damage sustained by customer, customer’s vehicle, or customer’s personal property, however caused. Valuables should not be left in vehicles. Vehicles should be locked. All damages and/or loss to vehicle or other property must be reported to Penn Parking, Inc. by the customer prior to the departure from the parking facility. If not reported prior to departure of the parking facility, customer agrees to release Penn Parking, Inc, and/or owner, and/or property manager its employees and/or agents, from all liability in all cases. In accepting this agreement, the customer agrees to assume any and all responsibility for all costs monetary or otherwise incurred in resolving any disputes however caused and associated with this contract not limited to payments and collection activities. These costs will include but not be limited to Penn Parking, Inc, and/or owner, and/or property manager its employees and/or agents. Parking attendants and/or cashiers are not authorized to make changes or amend in any manner these Terms and Conditions and/or any parking regulations stipulated at any Penn Parking, Inc. parking facility. Customer agrees to abide by any and all rules and regulations pertaining to the use of the parking facility as may from time to time be prescribed and posted by Penn Parking. Inc., and/or owner, and/or property manager. Any unauthorized or improperly parked vehicles are subject to being towed or immobilized at customer's expense. Except as otherwise provided herein, this Agreement may be terminated by either party only by giving to the other a minimum of ten days prior written notice with termination request, effective at midnight on the last day of the then current month. Customer shall be obligated to pay each month's monthly parking fees until this agreement is terminated by written notice by either party whether or not customer continues to use the parking facility. Should Customer at any time be in default of this Agreement, or misuse the parking privilege extended by this Agreement, or if the license fee is not received by Penn Parking by midnight of the day on which any such payment is due, then this Agreement shall be subject to immediate revocation at the option of Penn Parking.
